No. 28582 NOTICE OF PASSAGE OF SOUTHEAST WHITEFISH RURAL ZONING DISTRICT RESOLUTION OF INTENT The Flathead County, Montana Board of Commissioners hereby gives notice, pursuant to Section 76-2-205 (5), MCA, that it passed a Resolution of Intent (Resolution No. 1201Q) on April 28, 2022, to change the zoning designation in a portion of the Southeast Whitefish Rural Zoning District located at 2305 Dillon Road near Columbia Falls, Montana from AG-20 (agricultural) and SAG-10 (commuter agriculture) to SAG-5 (commuter agriculture). The boundaries of the areas proposed to be changed from AG-20 (agricultural) and SAG-10 (suburban agricultural) to SAG-5 (suburban agricultural) are described as follows: Parcel 1: the northern half of the northern quarter -west of Southwest Quarter (N1/2NW1/4SW1/4) of Section 10, Township 30 North, Range 21 West, PMM, Flathead County, Montana. Parcel 2: A parcel of land located in the northern half of the southern half of the northwest quarter of the southwest quarter (N1/2S1/2NW1/4SW1/4) of section 10, township 30 north, range 21 west, PMM, Flathead County, Montana, described as parcel c of survey certificate no. 2531. Regulations defining zones AG-20, SAG-10 and SAG-5 are contained in the Flathead County Zoning Regulations, filed for public inspection at the Office of the Clerk and Recorder, Courthouse, 800 South Main, Kalispell, Montana, at the Flathead County Planning and Zoning Office, 40 11th Street West, Kalispell, Montana, and at the site Flathead County Planning and Zoning Office web at: http://flathead.mt.gov/planning_zoning/downloads.php. The rezoning application and other documents related to the proposed rezoning are also filed for public inspection at the Office of the Board of Commissioners and the Flathead County Planning and Zoning Office. For thirty (30) days after the first publication of this notice, the Board of Commissioners will receive written comments on the proposed change to part of the Southeast Whitefish Rural Zoning District. Within 30 days of the expiration of the comment period, the Board of County Commissioners may, at its discretion, pass the resolution amending the Southeast Rural Whitefish Zoning District. The sale is a public sale and anyone, including the beneficiary, with the sole exception of the trustee, can bid at the sale. The auction price must be paid immediately after the auction closes in cash or near cash (valid money orders, certified checks or cashier’s checks). The transfer will be made by deed of trust without any representations or warranties, including warranties of title or possession, express or implied, as the sale is made strictly on an as is basis, without limitation, the sale being subject to all existing conditions, if any, lead paint, mold or other environmental or health hazards. The sale is subject to filing for bankruptcy, payment, reinstatement or any other circumstance affecting the validity of the sale. If the sale is canceled or the trustee is unable to pass title for any reason, the winning bidder’s sole and exclusive remedy shall be the return of funds paid to the successor trustee, and the winning bidder shall have no no other remedy. The sale scheduled by the trustee may be postponed by public proclamation for up to 15 days for any reason, and in the event of a bankruptcy filing or other court-ordered stay, the sale may be postponed by the trustee until ‘to 120 days by public proclamation at least every 30 days. The settlor, the settlor’s assign or any other person having an interest in the aforesaid property, at any time prior to the sale by the trustee, may pay to the current beneficiary the full amount then due under the trust deed. . and the obligation so secured (including costs and expenses actually incurred and attorneys’ fees) other than that part of the principal which would not then be due but for the default and thereby remedy the default hitherto existing .
